1. Assumption of risk *

Falling from a surfboard Impact with seafloor, reefs, rocks, sandbanks, submerged objects, other surfers and surfboards Collisions in the surf zone Tides, rips, waves, currents, weather and marine life Physical exertion, fatigue, dehydration, or medical events

I understand that surfing and surf coaching involve significant inherent and obvious risks, and I freely and voluntarily accept all such risks, including the risk of serious injury or death.

2. Release of Liability *

To the fullest extent permitted by law, I release, discharge and hold harmless Kook Surf Coach and its owners, officers, employees, contractors, agents and affiliates (“Releasees”) from any liability, claims or actions connected with my participation, including those caused by ordinary negligence. This release does not apply to gross negligence, wilful misconduct, or where liability cannot be excluded by law.

3. Indemnity *

I agree to indemnify and hold harmless the Releasees against any claims or proceedings brought by third parties as a result of my actions during participation.

4. Medical & Fitness Declaration *

I declare I am medically and physically fit to participate and will advise Kook Surf Coach of any condition that may affect my ability to take part safely. I consent to receive medical treatment if required in an emergency and agree to cover all associated costs.

5. Equipment & Personal Property *

I accept responsibility for damage to Kook Surf Coach equipment caused by my negligence or improper use. I understand the Releasees are not responsible for loss of or damage to my personal property, except where required by law.

6. Program Changes & Cancellations *

I acknowledge that sessions may be altered, postponed or cancelled due to surf, tides, weather, safety, or environmental reasons. I release the Releasees from liability for such decisions made in good faith to protect participants.

7. Governing Law & Severability *

I agree this Agreement is governed by Queensland law. If any part is found invalid, the rest remains in full effect. To the extent the law prohibits waiver of rights, this Agreement shall be read down to the maximum extent permitted.
